City of St. John's Council Minutes
November 29, 1999

The regular meeting of the St. John's Municipal Council was held in the Council Chamber, City Hall, at 4:50 p.m. today.

Mayor Andy Wells presided.

There were present also Deputy Mayor White, Councillors Miller, Duff, Wyatt, O'Keefe, Hanrahan, Galgay, Coombs, Colbert and Dinn.

The Chief Commissioner/City Solicitor, City Clerk, Associate Commissioner/Director of Engineering & Planning, and the Manager, Corporate Secretariat were also in attendance.

Mr. Colin McDonald, Intern with the Legal Department and Ms. Jennifer Fitzgerald, Co-op Student from Bishop's College, were also in attendance.

1. Belvedere Property - Application for Rezoning and Approval of a  Townhousing Subdivision Myles Leger Limited (Ward 2)

The Committee considered the attached memorandum dated November 17, 1999 from the Manager of Planning and Development regarding an application from Myles-Leger Ltd. to have property situated on Bonaventure Avenue (between Holy Heart High, Brother Rice Junior High and Newtown Road) rezoned from the Public (P) and Open Space (OS) Zones to the Residential High Density (R3) Zone and to subdivide the property to allow development of a residential subdivision (114 townhousing units). The Manager of Planning and Development displayed the preliminary subdivision concept plan.

It was noted by the Engineering and Planning Department that the development of the property conforms with the Municipal Plan policy which seeks infilling and new housing in established areas and a variety of housing stock. However, the proposed development has several deficiencies and possible ownership questions, and the concerns of the Avalon East School Board should be taken into account before rezoning is contemplated. A residential development of the portion of the site near Newtown Road, with more spacing between the schools, appears to be more suitable than the current rezoning/development application.

Following discussion, the Committee recommends that the rezoning application submitted by Myles-Leger Ltd. to permit a Townhousing Subdivision on the Belvedere Property be rejected.
